Terms of Agreement for online trading between ICON BRAND^TM (ABN 19 074 433 122) ("ICON BRAND^TM") and the user of this website ("You/Your"). Please read them carefully before proceeding with entering this Website. You must accept these terms and conditions to access this Website any further.

 

 

PLACING AN ORDER AND PAYMENT

By completing a Purchase Order, You are making an offer to purchase the Product at the price set out in the Website.

 

Payment must be made at the time of submitting the Purchase Order. Payment can be made by credit card only. ICON BRAND^TM accepts Visa & Mastercard. You warrant that You are an authorised user of the credit card used to complete payment.

 

All Purchase Orders placed through this Website are subject to confirmation and acceptance by ICON BRAND^TM. We will email you with confirmation of the receipt of Your Purchase Order. ICON BRAND^TM may reject Your Purchase Order, and refund any payment made by You, at any time prior to dispatch.

 

The Purchase Order must be paid in full immediately upon entry into the Agreement. All transactions are settled in Australian Dollars (AUD). If you are ordering from outside of Australia, and your credit card is held in a different currency, your transaction will be automatically converted to Australian Dollars. The conversion rate varies from day to day with the current exchange rate. Many banks also charge a small currency conversion fee; contact your bank or credit card provider for more details. In some areas of the site, price is shown in USD. The final charge to your card is made in Australian Dollars and the ultimate conversion rate is determined by your bank or credit card provider. For this reason we are not able to take responsibility for the final amount charged to your card.

 

ICON BRAND^TM may vary prices in the event of price changes or mistakes on this website without prior notice to You. If ICON BRAND^TM_­ requests payment for increased prices, You may cancel the order. Notification of your wish to cancel the order in these circumstances must be received within seven days of the announcement of the increase.

 

This website is protected by SSL (Secure Socket Layer) encryption. SSL is a security device which ensures that any data which you enter into a secure area of the site is encrypted during transmission over the Internet. SSL utilises data encryption to create a secure environment for you to conduct your online transactions. In order for SSL to be effective, You must be using a SSL compliant browser.

 

ICON BRAND^TM does not store or keep credit card numbers from online transactions. The last four numbers and the expiry date of your credit card are kept for order verification purposes only. While every endeavour is made to ensure every shopping experience with us is a good one, in the event a credit card is used without the holder’s authorisation, the card holder must notify their credit card provider in accordance with their reporting rules and procedures.

 

ICON BRAND^TM­ reserves the right to limit the quantities of product sold as it sees fit. It is a condition of this Agreement that you do not resell the Products to a third party. ICON BRAND^TM does not permit the purchase of items for resale. Customer wishing to be a stockist of ICON BRAND^TM products must contact ICON BRAND^TM directly, where they will be informed of the options available to buy higher quantities.

 

This Website is owned and operated by ICON BRAND^TM. This Agreement supersedes all prior agreements and may be revised by ICON BRAND^TM from time to time.

 

 

YOUR USE OF THIS WEBSITE

You agree that You will use this Website in accordance with these terms and conditions and that You will not use this Website for any unlawful purpose.

 

You will not violate or attempt to violate the security of this Website. You will not hack into this Website, ICON BRAND^TM computer systems or the computer systems of other users of this Website. Hacking means the unauthorised access, malicious damage and/or interference and includes, without limitation, mail bombing, propagating viruses, worms or other types of malicious programs, deliberate attempts to overload a computer system, broadcast attacks or any other method designed to damage or interfere with the operation of a computer system or website.

 

 

WARRANTIES

All ICON BRAND^TM product comes with a 3 month warranty. ICON BRAND^TM will not be liable for any damage caused by any failure by You to maintain the Product properly. Please note that the colours of Product may vary slightly from those displayed by Your computer monitor.

 

Please note that the Trade Practices Act 1974 and similar State and Territory legislation in Australia may confer rights and remedies on you which cannot be excluded, restricted or modified ("Non-excludable Rights"). Notwithstanding any other term in this Agreement, ICON BRAND^TM does not exclude any Non-excludable Rights but does exclude all other conditions and warranties, whether implied by custom, law or statute.

 

 

RETURNS POLICY

 

Change of Mind

 

If You wish to return or exchange Product because of a change of mind, You may do so in accordance with the following process -

 

• ·         You must notify ICON BRAND^TM within 7 days of accepting delivery of the Product and arrange return of the Product within 7 days after such notification
• ·         You must notify ICON BRAND^TM by email sales@iconaustralia.com to obtain a "Return ID Number", or please call ICON BRAND^TM directly.
• ·         You must provide a "Proof of Purchase", being either an invoice, bank statement, email confirmation from ICON BRAND^TM, or a delivery note. Product must be returned to ICON BRAND^TM head office.
• ·         On international returns You must mark on the courier company’s consignment so that the Products do not attract possible customs duties and taxes again.
• ·         You must return the Product in its original condition with the original "swing ticket" attached.
• ·         You are responsible for the cost of shipment of the Product as well as organising insurance on the Product.
• ·         Upon receipt of the Product by ICON BRAND^TM your refund will be processed. The refund will be the purchase price for the Product, less any shipping costs.
• ·         Refunds can only be credited back to the credit card that was used to make the original purchase. The refund will be process as soon as the items have been received by ICON BRAND^TM, however, please allow up to 14 days from the day You return the Product for Your account to be credited.
• ·         Refund and exchanges will only be given for Products purchased through the ICON BRAND^TM Online Store. Refunds and exchanges will not be given to ICON BRAND^TM Products purchased from ICON BRAND^TM stockists.
• ·         Exchanges are only possible if the item is available. If you wish to make an exchange, please make this clear when requesting Your Return ID number.

 

 

Faulty or Damaged Product

 

If You wish to return a faulty or damaged Product, ICON BRAND^TM will gladly exchange or refund the original piece in accordance with following process -

 

• ·         That the Product was purchased within 3 months of the fault date
• ·         You must notify ICON BRAND^TM by email sales@samanthawills.com to obtain a "Return ID Number", or please call ICON BRAND^TM directly.
• ·         On international returns You must mark on the courier company’s consignment so that the Products do not attract possible customs duties and taxes again.
• ·         Refunds can only be credited back to the credit card that was used to make the original purchase. The refund will be process as soon as the items have been received by ICON BRAND^TM, however, please allow up to 14 days from the day You return the Product for Your account to be credited.

WEBSITE AVAILABILITY

From time to time down-time, either scheduled or unscheduled, may occur. ICON BRAND^TM will work within reason to ensure the amount of down-time is limited. ICON BRAND^TM will not be held liable for the consequences of any down-time.

If the Product has not been delivered to You prior to any termination of this Agreement by ICON BRAND^TM, ICON BRAND^TM will refund to You any payment You have made prior to termination.

 

 

DEFINITIONS

"Agreement" means the terms and conditions that apply to the use of this Website which may be amended from time to time.

"ICON BRAND^TM" means ICON BRAND^TM (ABN 19 074 433 122).

"Product/s" means the product that is specified on the Purchase Order as the product You wish to purchase pursuant to the Agreement.

"Purchase Order" means the online purchase order form to be completed by You in relation to Your purchase of the product.

"Website" means internet website with the URL www.iconbrand.com and associated websites.

"Online Store" means the shopping cart area of www.iconbrand.com.

"You" means the user of this Website (and "Your" has the corresponding meaning).
